RIGHTS AND OBLIGATIONS

Public Utility District No. 2 of Grant County, Washington (Grant PUD) will build the necessary electrical facilities on your property. In return, you give Grant PUD permission to construct, operate, patrol, maintain, and remove overhead and/or underground electrical distribution lines and related equipment to include; Fiber optic and gateway facilities.

Grant PUD maintains the right to clear the area where the distribution equipment and fiber optic facilities are located on the customer's property. Grant PUD will also ensure the property is kept clear of brush, trees, timber, structures, improvements, and all fire hazards around our equipment.

The customer agrees to not place, construct, or maintain any building, structures, or other improvements within a 10-foot area of Grant PUD electrical or fiber optic facilities. The customer agrees not to reduce or enlarge the required minimum clearances between the ground and any overhead or underground power or fiber optic lines. Failure to comply with these requirements will result in Grant PUD enforcing the requirements at the expense of the customer.

Legal Landowner of Record Signature

Your signature indicates you have read and agree to the Conditions stated in the “Rights and Obligations” section. The customer understands the work requested and authorizes Grant PUD to begin work as listed on the Service Connection Agreement form.The customer agrees to pay all charges associated with Construction.

Energy Efficiency Incentive Agreement

By signing below, I request an incentive for the work listed on this form. I certify that the information provided along with all accompanying documentation is complete and accurate. I further certify that all measures listed were fully installed as of the signature date. I understand that Public Utility District No. 2 of Grant County, Washington ("Grant PUD") will make the final determination regarding any incentive I may receive, and that verification of installation may be required after the rebate has been received.

Grant PUD disclaims all implied warranties on the energy efficiency upgrades described in this application. Grant PUD is not responsible for any representations related to the equipment, materials, or labor required to install energy efficiency measures nor for the cost of such equipment, materials, or labor.


Additional Conditions

  1. Eligibility & Applicability: Applicants must be a current Grant PUD electric customer. All upgrades must meet the measure-specific qualifications outlined in the Residential Qualifications List.
  2. Measure Specifications: All upgrades must be installed in accordance with manufacturer specifications and performed by a licensed contractor.
  3. Code Compliance: Applicants are responsible for complying with all applicable federal, state, and local codes, ordinances, and permitting requirements. Incentives are not provided if upgrade is required to meet the WA State Energy Code, and upgrades above the energy code may be considered for incremental savings.
  4. Inspection: Grant PUD reserves the right to inspect energy efficiency measures prior to payment and will coordinate inspections as applicable.
  5. Payment Method: Incentives are paid directly to the applicant (by check or ACH, as designated by Grant PUD's program terms).
  6. Application Timing: Incentive applications must be submitted within twelve (12) months of completion of the energy efficiency measure, unless otherwise stated in program materials.
  7. Documentation: Applicant must provide required documentation outlined in the measure-specific Rebate Application (e.g., itemized invoices/receipts, specification sheets, AHRI/ENERGY STAR certifications where applicable).
  8. Processing Time: Allow 6–8 weeks for processing and payment of incentives after all required documentation is received and any inspections are completed.
  9. Non-Transferability: Incentives are non-transferable and apply only to the premises and applicant listed on the application.
  10. Program Conflicts: Incentives may not be combined with other overlapping Grant PUD incentives for the same measure unless expressly authorized by Grant PUD program rules.

Savings Statement

Any funding provided by Grant PUD under this agreement is at the request of the applicant. Because of the variability and uniqueness of individual energy use, it is not possible to predict exact energy savings (if any) that may accrue to any participant. Grant PUD, by providing funding, does not guarantee that the equipment will achieve any reduction in energy costs for the applicant.


Incentive Amounts Statement

Grant PUD determines deemed savings based off the Unit Energy Savings (UES) list in effect. Grant PUD establishes rebate amounts based on the cost effectiveness of the measure and budget restrictions. Grant PUD reserves the right to cap projects that exceed 1,000 megawatt hours and/or seek third party review per Grant PUD's discretion. Grant PUD will assign savings by the date the rebate is paid unless otherwise recognized.


Release & Indemnity

As part of the consideration for this agreement, applicant hereby releases and shall indemnify, hold harmless, and defend Grant PUD from any and all claims, losses, harm, costs, liabilities, damages, and expenses (including attorney's fees) of any nature whatsoever arising directly or indirectly out of or in connection with the installation of energy efficiency measures at the premises or any material and labor required for such installation or arising directly or indirectly out of or in any way connected with the payment of the incentive or applicant's participation in Grant PUD's energy efficiency incentive program.


Entire Agreement / Program Terms / Assignment

The terms and conditions of Grant PUD's energy efficiency incentive programs, as amended from time to time, are incorporated into this Agreement as if fully set forth herein. Applicant acknowledges responsibility to review current program requirements. Applicant may not assign rights or obligations under this Agreement without Grant PUD's prior written consent.


Verification

Grant PUD shall have the right to verify equipment and materials installed on the Applicant Premises. These Residential Energy Efficiency Programs are ongoing as part of Grant PUD's continued commitment to energy efficiency.


Reservation of Rights

Applicant acknowledges and agrees that Grant PUD retains the sole and exclusive right, in its sole discretion, to reject, deny, adjust, or amend any application and any incentive payments made pursuant to this Agreement and Grant PUD programs and policies. All incentive amounts, if any, shall be made or not made within Grant PUD's sole discretion. Participation in this program does not guarantee any incentive payment.
